ZestPik Terms & Conditions
A customer placing an order or business partnering with zestpik to host a product on ZestPik's website (https://zestpik.in) or through an online method form agrees to abide by the following terms and conditions.
1. Rental contract
By hiring a product, the user enters into a rental contract with ZestPik, wherein ZestPik transfers the rights to use the product to the customer on payment of the rent to Zestpik. Thus, the customer is the deemed owner of the usage rights of the good. In no way does this contract signify that the good(s) belong to you permanently and the same has to be returned to ZestPik partnered business in the original condition in which it was delivered to you.
Businesses partnering to host products on zestpik enter into contracts with zestpik, wherein Zestpik provides features to host their products on the site. Businesses are prohibited from posting pornographic content other than their business-related information or products on the site, even persons are prohibited to rent themselves on the zestpik platforms.
2. Span of contract
The span of the contract is equivalent to the span of the contract that has been chosen by the customer while placing the order. The return date is fixed and is imprinted on the invoice, the product has to be returned in as-is condition, by the return date, as it is picked from the zestpik partner business.
In case you want to return the product earlier, before the end of your span, there will be no refund of the rental amount collected from you, whatsoever. In case you want to extend the span, it can be done based on the availability of the product and at the discretion of ZestPik partner business.
Businesses have a span of their chosen premium plans before listing on the platforms.
3. Payment Policy
The total payment of each order includes the rental amount, refundable deposit ( for some categories ), and delivery/pick-up charges if any.
The payment can be done online while placing the order or upon delivery via a payment link.
The business will be settled with weekly payments, or they can request daily payments.
4. Delivery & Pick-up Policy
Deliveries are usually business interests you can opt for delivery and pickup based on the services provided by a particular business.
Or you can raise a request for ZestPik to deliver or to pick, if we receive the majority of the requests, we will try to figure it out.
5. Damage Policy
In case of any damage or missing product(s), the business has to inform the tenant and ZestPik upon receiving the product back. The tenant agrees to pay for any damage to, loss of, or theft (disappearance) of items, regardless of cause or fault.
What is considered damage?
Any permanent change in the physical appearance of the product or any change or loss of functionality of the product is considered damage.
Deposit Deduction
If the product rented by you qualifies to be considered as damaged, the damage cost will be deducted from the security deposit paid by the customer. In case the damage or loss of the product is greater than the amount of the security deposit, the customer will be responsible. And it is totally dependable on particular business.

Irreparable Damage
Pay 80-85% of the product’s current retail price depending on the age of the product. After payment of charges, you keep the product with you.
Loss or Theft
Pay 80-85% of the product’s current retail price depending on the age of the product.
Note: It is dependable on a particular business.
6. Security Deposit Refund Policy
If the product quality check is complete without any reports of damage to the product, the whole amount of the refundable deposit will be refunded to the customer without any interest within 3 working days of the receipt of the goods.
The refund will be processed via a payout link which will be sent via email/SMS/WhatsApp, where the customer is expected to enter his/her account details. Both NEFT and UPI transfer options are available.
Note: The deposit amount is based on the product you hire from a particular business and whether it is in the interest of the business to collect it or not.
7. Verification Policy
All customers must complete a verification process as set by the company. Verification can be completed by the customer before or after placing the order. The order will be confirmed only once the verification is approved. This is only to ensure the safety & security of the products rented out by the partnering business. ZestPik may ask you to do the following verifications.
• Identity
verification using Aadhar / driving license/passport/voter ID

Occupation verification using official email/employee ID/business
card / social media handle
• PAN verification using PAN number
and associated mobile number
• Address Proof using rental
agreement/passport / Aadhar / or a utility bill
One of the verifications (identity or occupation) needs to be done via the OTP method to successfully verify your identity.
In case the verification is not completed by the customer or is not satisfactory, ZestPik reserves the right to cancel the order. In such an event, any payment made by the customer will be refunded back to the customer within 3 working days.
8. Extension Policy:
In case the customer is not able to return the product(s) as per the actual return date and time, the customer is liable to pay the rent and extend the return date. There are no penal charges just the rent for the additional days.
9. Governing Law, Jurisdiction and Dispute Resolution
• The Terms and the use of the website are governed by and construed by the laws of India.
• In the event any dispute or difference arises between the User and ZestPik in connection with the validity, interpretation, termination, and implementation or alleged breach of any provision of the Terms (“Dispute”), both Parties hereto shall endeavor to settle such dispute within 14 days, amicably with each other and in good faith.
• Upon failure to amicably settle any Dispute, the dispute shall be resolved by arbitration by the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a single arbitrator appointed mutually by both parties. The venue and seat of arbitration shall be Hospet, Vijayanagara, Karnataka, India. The arbitration proceedings shall be conducted in English. The arbitral award shall be substantiated in writing. The decision of the arbitrator shall be final and binding on both parties.
• The courts of Hospet, Vijayanagara, Karnataka, India shall have the sole and exclusive jurisdiction in respect of any matters which may be instituted before any court of law, arising from the use of the services offered by ZestPik.
